1. Agreement to Terms
These Terms of Service (“Terms”) govern your use of the website at texaire.com and any HVAC services provided by TexAire Heating & Air Conditioning (“Company,””we,””us,” or “our”), operating under Texas HVAC License #TACLA96420E, with offices at 2018 Briarcliff Rd, Lewisville, TX 75067. By accessing our website or engaging our services, you agree to be bound by these Terms.
2. Services Provided
TexAire Heating & Air Conditioning provides residential and commercial HVAC services including: AC installation, AC repair, AC maintenance, HVAC replacement, heating installation, heating repair, heating maintenance, furnace services, heat pump installation and repair, air duct cleaning, air purifier installation, smart thermostat installation, attic insulation, attic packages, Jellyfish Lighting installation, HALO water filtration system installation, and indoor air quality solutions.
We serve Lewisville, Flower Mound, Carrollton, Coppell, The Colony, Argyle, Corinth, Lake Dallas, Frisco, Plano, McKinney, Allen, Richardson, Farmers Branch, Rowlett, Rockwall, Grapevine, Southlake, Roanoke, Colleyville, Bartonville, Prosper, and surrounding DFW communities. We reserve the right to decline service requests at our discretion.
3. Estimates, Pricing, and Guarantees
TexAire provides upfront pricing before any work begins. Our technicians present a clear estimate and explain your options before proceeding. By authorizing work, you agree to pay the final invoice for services rendered.
10% Price Beat Guarantee: TexAire will beat any competitor’s apples-to-apples written estimate by 10%. This guarantee applies to equivalent scope, equipment, and service terms.
Never Breakdown Guarantee: Any HVAC system tune-up performed by TexAire is backed by our Never Breakdown Guarantee. If your system breaks down after our maintenance visit, we will refund the cost of the tune-up.
Complimentary Second Opinions: TexAire provides free second opinions on competitor diagnostics recommending full HVAC system replacement.
Free Estimates: Available for qualifying services including indoor air quality assessments, duct cleaning, attic insulation, and system installations.
Financing: Options are available for qualifying HVAC installation and replacement projects. Details will be provided during consultation.
4. Payment Terms
Payment is due at the time services are completed unless a prior written credit arrangement has been established. We accept payment methods communicated at the time of service. Unpaid balances may be subject to collection proceedings and any associated costs.
5. SMS Communications Consent
By providing your mobile phone number and requesting service, submitting a contact form, or scheduling an appointment through our website or by phone, you consent to receive text messages from TexAire Heating & Air Conditioning. These messages may include appointment confirmations, technician dispatch updates, service reminders, and, where you have opted in, promotional offers such as our $79 Service Call Special, $89 Tune-Up promotion, and seasonal maintenance reminders.

Your mobile number and SMS opt-in information will not be sold, rented, or shared with third parties for their own marketing purposes.
6. Emergency Services
TexAire provides 24/7 emergency HVAC services across Lewisville and the DFW area. Emergency calls are handled based on technician availability and location. Our team makes every reasonable effort to respond same-day. Upfront pricing applies to all emergency calls with no hidden emergency surcharges.
7. Warranties and Service Guarantees
TexAire backs all workmanship and installations with our satisfaction commitment. Manufacturer warranties apply to all new HVAC equipment installed by our licensed technicians. Specific labor warranty terms will be communicated at the time of service.
The Never Breakdown Guarantee covers tune-up services only. It does not apply to pre-existing system conditions not disclosed at the time of service, damage from misuse, third-party modifications, acts of nature, or issues unrelated to the maintenance we performed.
8. Brands Serviced
TexAire technicians service all major HVAC brands and models including Carrier, Trane, Lennox, Goodman, Rheem, York, Daikin, American Standard, Amana, and Bryant, among others. Service covers air conditioners, furnaces, heat pumps, and ductless mini-split systems regardless of age or manufacturer.
9. Limitation of Liability
To the fullest extent permitted by applicable law, TexAire Heating & Air Conditioning shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from the use of our services or website, including property damage, loss of use, or loss of business income.
Our total liability for any claim related to services rendered shall not exceed the total amount paid by you for those specific services.
10. Intellectual Property
All content on our website, including text, images, logos, service descriptions, the TexAire name and branding, and marketing materials, is the property of TexAire Heating & Air Conditioning or its licensors and is protected by applicable intellectual property laws. Reproduction, distribution, or creation of derivative works without our express written permission is prohibited.
11. Third-Party Links and Services
Our website may include links to third-party websites such as financing partners, Google reviews, Yelp, the Good Contractors List, the BBB, and equipment manufacturer sites. We do not control or endorse those sites and are not responsible for their content, privacy practices, or accuracy. Jellyfish Lighting is a third-party product we are authorized to install; its own manufacturer warranties and terms apply.
12. Disclaimer of Warranties
Our website and its content are provided “as is” without warranties of any kind, express or implied. We do not warrant that the website will be uninterrupted, error-free, or free of security vulnerabilities.

These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Denton County, Texas.
